1.The categorization of businesses

An organization can be categorized as a micro, small, or medium-sized business based on the MSME registration criteria listed below, specifically:

a microbusiness, with a revenue of little more than five crore rupees and an investment in plant, machinery, or equipment not exceeding one crore rupees;

a small business, with a turnover of little more than fifty crore rupees and an investment in plant, machinery, or equipment not exceeding ten crore rupees; and

A medium-sized business, with a turnover of no more than 250 million rupees and an investment in plant, machinery, or equipment not exceeding fifty crore rupees.
2. GROWING INTO A SMALL, MEDIUM, OR MICRO ENTERPRISE

Anyone wishing to start a micro, small, or medium-sized business can apply for Udyam Registration online using the Udyam Registration portal. This process is based solely on self-declaration and does not need the uploading of any paperwork, certifications, or other supporting documentation.

An enterprise (referred to as “Udyam” on the Udyam Registration portal) will receive a permanent identity number upon registration, which will be referred to as the “Udyam Registration Number.”

Upon successful completion of the registration process, an electronic certificate known as the “Udyam Registration Certificate” will be issued.
3. COMPOSITE CRITERIA FOR CLASSIFICATION: INVESTMENT & TURNOVER

To classify an enterprise as micro, small, or medium, a combined criterion of investment and turnover will be used.

An enterprise will be placed in the next higher category if it exceeds the ceiling limits specified for its current category in either of the two criteria: turnover or investment. No company will, however, be dropped to a lower group until its turnover and investment levels drop below the upper bounds set for that category.

All units that have the same Permanent Account Number (PAN) and Goods and Services Tax Identification Number (GSTIN) stated will be considered as a single enterprise, with the turnover and investment data for each of these businesses will be viewed together; only the total amounts will be taken into account for classifying an entity as a micro, small, or medium-sized business.
COMPILATION OF PLANT AND MACHINERY OR EQUIPMENT INVESTMENT

The Income Tax Returns (ITR) from prior years submitted in accordance with the Income Tax Act of 1961 shall be connected to the computation of investment in plant and machinery or equipment.

If the business is new and no previous ITR is available, the investment will be based on the promoter’s self-declaration. This relaxation will expire on March 31, the year the business files its first ITR.

“Plant and machinery or equipment” refers to the same things as “plant and machinery” in the Income Tax Rules, 1962, which were created in accordance with the Income Tax Act, 1961. This includes all material possessions (apart from real estate, buildings, furnishings, and fixtures).

If the business is new and has no ITR, the purchase (invoice) value of any plant, machinery, or equipment, whether acquired new or used, will be considered, minus Goods and Services Tax (GST), on a self-disclosure basis.

The amount of investment in plant and machinery shall not include the cost of any goods listed in Explanation I to sub-section (1) of section 7 of the Act.
REGISTRATION PROCESS

The Udyam registration process requires an Aadhaar number.

The Aadhaar number belongs to the controlling partner in a partnership firm, the proprietor in a proprietorship firm, or the karta in a Hindu Undivided Family (HUF)

The organization or a designated signatory must supply the Aadhaar number, GSTIN, and PAN of any company, limited liability partnership, cooperative society, society, or trust.

If an organization has properly registered as an Udyam with a PAN, any information gaps for prior years in which the organization lacked a PAN must be completed on a self-declaration basis.

No business may submit multiple Udyam Registrations: As long as each Udyam Registration specifies or adds a maximum of one manufacturing activity, one service activity, or both.

(8) The penalties outlined in section 27 of the Act will apply to anybody who willfully falsifies or tries to conceal the self-declared facts and figures that appear in the Udyam Registration or updating procedure.
Udyam registration certificate
